Terms of Service

1. Definitions

·     We/Us/DutchPosture: DutchPosture, the operator of this webshop.

·     Customer/You: any individual or legal entity purchasing Products via our website.

·     Products: all health-related items offered for sale on dutchposture.com.

·     Agreement: the purchase agreement between DutchPosture and the Customer.


2. Applicability

2.1 These Terms of Service apply to all offers, orders, and agreements made through our webshop.
2.2 Any deviations from these terms are only valid if expressly confirmed in writing by DutchPosture.
2.3 By placing an order, the Customer unconditionally accepts these terms.


3. Offers & Pricing

3.1 All offers are non-binding and subject to availability.
3.2 Prices include VAT unless otherwise stated.
3.3 Shipping, handling, or other fees will be clearly shown during checkout.


4. Order & Formation of Contract

4.1 An order becomes binding when you click the order button and we send a confirmation email.
4.2 We reserve the right to refuse orders—e.g., in cases of suspected abuse or incomplete information.


5. Payment

5.1 We offer secure payment methods (iDEAL, credit card, PayPal, Klarna etc.).
5.2 Unless agreed otherwise, payment is due in full before shipment.
5.3 In case of non-payment, we reserve the right to cancel the order or suspend your account.


6. Delivery

6.1 In the Netherlands, we usually deliver within 1–3 business days (longer for other countries). Check our Shipping Policy for more details about shipping.
6.2 Delivery will be made to the address you provided.
6.3 We are not liable for delays outside our control (e.g., extreme weather, carrier strikes).


7. Returns & Cancellation

7.1 You may cancel non-defective items within 30 days of receipt, for any reason.
7.2 Return shipping is at your expense, unless the item is defective.
7.3 Return instructions and address will be provided with your order confirmation or upon contacting 
service@dutchposture.com.
7.4 Defective or incorrect items will be replaced free of charge and do not need to be returned.
7.5 Once we receive and inspect your return, we will issue a 100% refund to your original payment method within approximately 10 business days. Please see our
Refund and Return Policy for more details.


8. Warranty & Conformity

8.1 We guarantee that our Products comply with all applicable Dutch and EU regulations.
8.2 Standard warranty period: 2 years from delivery.
8.3 For defects or malfunctions within this period, contact Customer Service. We will at our discretion repair or replace the product at no cost.
8.4 Warranty does not cover misuse, accidents, normal wear and tear, or unauthorized modifications.


9. Liability

9.1 Our liability is limited to direct damages caused by our gross negligence or intent.
9.2 Total liability per order will not exceed the purchase price of the relevant Products.
9.3 We are not liable for indirect or consequential damages, lost profits, or loss of savings.


10. Privacy & Data Protection

10.1 We process personal data in accordance with our Privacy Policy.
10.2 Order details, delivery addresses, and payment information are used solely to fulfill your order.
10.3 You have the right to access, correct, or delete your personal data by emailing 
service@dutchposture.com.


11. Intellectual Property

11.1 All content on this site—text, images, logos, and databases—remains the property of DutchPosture or its licensors.
11.2 No part of this site may be reproduced, distributed, or made public without prior written consent from DutchPosture.


12. Changes to These Terms

12.1 We reserve the right to amend these Terms of Service.
12.2 Changes will be published here and become effective 14 days after posting.
12.3 Orders placed before a change will remain subject to the terms in effect at the time of ordering.


13. Governing Law & Dispute Resolution

13.1 Dutch law governs all agreements.
13.2 Any disputes will be submitted exclusively to the competent court in Amsterdam, unless the EU Distance Selling Directive requires otherwise.
